I was watching The Late Late Show with Craig Ferguson the other night, and Betty White was on, talking about the elephants at the LA Zoo. Of course, Betty White has been an animal rights supporter for years. I wondered what would happen of the lawsuit that Culp filed and their appeal. Apparently, it is still scheduled to go through. I'm by no means an attorney, but given that Culp is deceased and can't make his complaint, it may be dismissed once again due to that issue as it was sent back for trial by the appellate court for a retrial.
If it's dismissed again, I would guess that they'd have to refile it with new people and new complaints - which can happen now that it's officially open (at least as of the date of the link you gave). I don't know if double indemnity would come into play though if it's dismissed.
HD - do you have any clues here that can help us out?

It would depend on how it was filed. There may have been others in the suit, etc. that would allow it to go. I'm not 100% on it, especially in another state, but if dead people can get elected, I fail to see why a dead guy can't win a lawsuit.

I'm beginning to agree with you on that - especially with recent news and the like.
Personally, I'm still thinking it'll be dismissed again and they'll have to refile with new charges of mistreatment and the like since it's been open for a time now.
If it is indeed too small though, I would want them to have to expand it again. It'll be an interesting case to follow though.

I'm not sure they would have to dismiss and refile, but it might be better so there was a living person on the other end fighting for it.
